LEGAL PROTECTION FOR INDONESIAN MIGRANT WORKERS FOR JUSTICE AND WELFARE

Background - Article 4 of Law Number 13 of 2003 concerning Employment explains that there is equal
distribution of employment opportunities and the provision of labor as well as protection for workers in an effort to create prosperity for themselves and their families. Work is a necessity for workers to get wages according to their desires. Indonesian Migrant Workers are workers who do work by leaving their own country or leaving Indonesia
to get a decent wage to meet the necessities of life for themselves and their families.
Purpose - The aim of the research is to examine and analyze legal protection for the existence of Indonesian
Migrant Workers (PMI) who carry out work outside the territory of the Unitary State of Indonesia in order to obtain
decent wages to meet the needs of themselves and their families.
methodology - The research methodology used in this writing is a normative legal research method, namely legal research that seeks to examine the application of positive law used in society related to Indonesian Migrant Workers. Normative juridical research uses secondary data with primary, secondary and tertiary legal materials.
Meanwhile, empirical data is a complement to research analysis of the implementation of regulations in society.
Findings - The research resulted in the finding that legal protection and legal certainty are needed for Indonesian Migrant Workers considering the many ongoing problems facing Migrant Workers abroad. Indonesian Migrant Workers who work abroad have the desire to get work and decent wages for the work they do, but in practice
there are still Indonesian Migrant Workers who do not fare well and receive treatment that violates human rights from employers or employers and/or service bureaus. irresponsible company
Originality - This research giving an original sense that Protection of Indonesian Migrant Workers is all efforts that
must be carried out continuously for prospective Indonesian migrant workers and/or Indonesian Migrant Workers before, during and after entering into employment as mandated by statutory regulations.
