LEGAL PROTECTION OF COPYRIGHT ON FILMS ILLEGALLY ACCESSED THROUGH THE WEBSITE

Background - Technological advances in the era of globalization have revolutionized society by providing easier access to information and entertainment, especially movies. The number of legal streaming services has made it easier for viewers to watch movies from their homes. The downside of this advancement is the rise of digital piracy through illegal websites that distribute films without the consent of copyright holders. This not only violates intellectual property rights but also causes significant financial losses to the film industry, which has an impact on creators and the economy.
Purpose - This study aims to understand and analyze the protection of copyright law for films that are accessed illegally through websites and the factors that hinder the enforcement of copyright law in Indonesia.
methodology - This study uses a normative juridical method, by analyzing legal documents, regulations, court decisions, and relevant literature. Data sources include primary legal materials such as laws and regulations, secondary materials such as legal commentary, and tertiary sources such as dictionaries and legal encyclopedias.
A qualitative approach is applied to provide an in-depth understanding of the legal framework and enforcement challenges.
Findings - The results of the study show that the Copyright Law No. 28 of 2014 and supporting regulations from the Ministry of Law and Human Rights and the Ministry of Communication and Information provide a strong legal foundation. However, enforcement is still difficult due to low public awareness, the appeal of illegal platforms that are free or low-cost, and the ease with which offenders create new domains after existing domains are blocked.
Other challenges include limited resources to monitor and prosecute violations, inadequate interagency
coordination, and the evolving nature of digital piracy. To address these issues, a diverse approach is needed, including public education, stricter regulations, improved technological monitoring systems, and better collaboration between stakeholders. Empowering law authorities to impose effective penalties can also strengthen law enforcement. By fostering a culture that values intellectual property, Indonesia can protect its creative
industries, ensuring their growth and sustainability. A comprehensive strategy that combines preventive, enforced, and collaborative measures will help combat digital piracy, creating a more equitable and prosperous creative industry.
